Disclaimer & Terms of Service

Authorization
 
Shugenja Autoworks has the legal right to authorize repairs/services of listed vehicle, engine, or components',  either through legal ownership, lease rights, written or verbal authorization from the owner. When you approve an estimate with Shugenja Autoworks, you authorize Shugenja Autoworks to take the steps necessary to perform the repairs/services requested, and agree to the terms listed in this contract, along with necessary materials or fees. You authorize Shugenja Autoworks and their contractors to operate any listed vehicle for the purpose of testing, inspection or delivery at your risk.  Shugenja Autoworks will not be responsible for loss or damages to vehicles, parts, components, and/or to articles left in vehicle, in case of fire, theft, accident, or any other cause beyond control. 

Breach or Cancellation of Authorized Repair/Build Contract on approval may result in Fees applicable but not limited to: Storage Fees, Restocking Fees, Research & Development Fees, Order Arrangements Fees, Diagnosis Fees, Project Inspection Fees, Project Preparation Fees, and Shop Resource/Supply Fees.
 
Payment
 
You agree to pay in full for the services described in your invoice of all listed Labors & Parts/Components & services prior to pick up from Shugenja Autoworks. You agree to pay for all parts, labor, fees, taxes, and other charges incurred during the performance of any repairs/services authorized in writing or verbal agreement. Shugenja Autoworks will provide an invoice upon completion of repairs detailing all fees, and listing a final outstanding balance for payment. Payment must be made in full before Vehicles, Engines, or Components will be returned to you. Shugenja Autoworks may opt to release Vehicles, Engines, or Components to you upon partial payment if agreed upon by both parties in a sub contract.
 
 
Repair Process & Repair Disclaimers
 
Analysis: A specialist will evaluate the project and create a report listing all necessary repairs or services necessary to complete work. This report details any damage or outstanding maintenance required, upgrades or recommended course of action for project undertaking; and includes expected repair costs. This report is then delivered to the customer, and is used to create the repair description and cost itemization in an invoice contract.
 
Additional Damage: During the repair/service process, additional problems may be uncovered. In the event that a Shugenja Autoworks specialist discovers the need for repairs/services outside of those listed in the estimate contract; work on the vehicle will cease, and written or verbal notification of required additions will be sent to you. Shugenja Autoworks will not perform any repairs/services outside of those listed in the estimate contract without prior written or verbal authorization from you.
 
Broken Hardware: Shugenja Autoworks is not responsible for bolt breakage under any circumstances, even if the bolt in question broke by our hand. The reasons for this are multiple: Shugenja Autoworks has no way of knowing if a previous repair effort damaged the bolt or the threads into which it screws. Shugenja Autoworks has no way of knowing if a bolt was damaged due to environmental factors, as some bolts are prone to breakage due to the environment within which they exist (e.g., bolts affixing exhaust system components), and sometimes a bolt will just fail no matter how carefully and gently you work with it. If a bolt breaks, Shugenja Autoworks will charge additional labor, and parts if needed, to extract the remaining bolt fragment and repair threads.
 
Plastic Parts: Shugenja Autoworks assumes no responsibility for plastic part breakage, as many plastic parts used in vehicles are brittle and can break without warning no matter how carefully they are handled. This is especially true of plastic parts that are exposed to sunlight, e.g., dash pads. Shugenja Autoworks specialist's do their absolute best to provide care in removal of these components, but can not be held responsible for them.
 
Old Parts: You have the right to request your old parts be made available to you for your inspection, provided that such a request is made when work is approved. If a core charge applies to any given part, it needs to be paid in full if you request it returned to you. If you do not request your old parts upon pickup of vehicle after 24hours THEY WILL BE DISCARDED!
 
 
Non-OEM Parts & Performance Parts
 
While you have the sole right to choose which parts are used for repairs/services, Shugenja Autoworks reserves the right to exercise professional judgement and refuse to make repairs using parts which are deemed inadequate, unsafe, or unreliable. In recognition of the above risks, Shugenja Autoworks advises that you the customer, take the above risks into account when choosing parts for necessary repairs or performance upgrades. You acknowledge that any Non-OEM Parts, Performance Parts may lead to the following:
 
Performance Parts: Performance parts, including exhaust products, are sold and installed for OFF-ROAD use only.  When Shugenja Autoworks installs non EPA Compliant parts: we do so with the assumption you the customer have educated yourself on local emissions laws and regulations, and understand the vehicle will be used for OFF-ROAD use only and installing some parts may make the vehicle unable to comply with EPA emissions requirements. Shugenja Autoworks is not held liable for your vehicle if it fails inspection.  All performance modifications and installations are made at YOUR OWN RISK!  Shugenja Autoworks holds no responsibility either implied or otherwise for mechanical, electrical or another failure when using any aftermarket performance products. Items sold or installed for OFF-ROAD use only are illegal in many states and provinces and are intended for track purpose racing vehicles which may never be used on a public road. By purchasing or paying for labor services on any aftermarket performance product, you take full responsibility for any use, and/or misuse of the product and agrees that Shugenja Autoworks holds no responsibility for any consequences, legal, or other, of such use and/or misuse.
 
Lease or Finance Violation: Some lease and finance contracts require the purchaser or lessee to make repairs using only original manufacturer parts (“OEM Parts”).  Aftermarket parts used in repairs may violate these contracts. Decrease in Value: Repairs made using aftermarket parts may lead to increased depreciation and lost vehicle value. Shugenja Autoworks is not liable for potential decrease in Vehicle Value. Manufacturer Warranty: Some vehicle manufacturers require that all repairs be made using only OEM parts. Use of aftermarket parts may void vehicle warranties.  Shugenja Autoworks is not liable for any Void of factory warranty of Lease / Finance Violations due to install of aftermarket components or accessories.
 
Tuning: After the install of most performance parts, an adjustment to the vehicles PCM/EFI System may be required for the engine to operate within a safe, efficient, and reliable manner.  Shugenja Autoworks Does offer OFF-ROAD Use only tuning options on engine management systems that we selectively choose. Shugenja Autoworks has the right to refuse tuning on Hardware we are unfamiliar with.   Shugenja Autoworks may offer a Base Map for a Standalone EFI System to allow the initial start and operation of an engine for the owner to have tuned elsewhere. However, Shugenja Autoworks WILL NEVER ADVISE YOU TO DRIVE OR CONTINUALLY OPERATE THE ENGINE ON A BASE MAP TUNE OR STOCK TUNE AFTER MODIFICATIONS. DOING SO IS AT YOUR OWN RISK AND MAY CAUSE ENGINE FAILURE OR FATAL HARM TO YOU OR PASSENGERS. IT IS HIGHLY RECOMMENDED THAT YOUR VEHICLE BE TOWED DIRECTLY TO A PROFESSIONAL TUNER AND TUNED BEFORE OPERATING UNDER NORMAL CONDITIONS.  Shugenja Autoworks assumes no responsibility in the event you choose to operate your vehicle in such scenario described above.

Emissions: Due to the continual changing regulations of emission regulations via the EPA, Shugenja Autoworks takes NO responsibility for failure of customers not adhering to county required emission regulations. Aftermarket Performance parts are for OFF ROAD Use only. Installing these components can eliminate the requirements for a vehicle to properly function under EPA Laws of designated states or counties. Under no circumstances does Shugenja Autoworks recommend the owner delete emissions components if they plan to operate a vehicle for street use in a County that requires said emission equipment to be operable.
 
 
Standard Labor Warranty

Shugenja Autoworks
 shall provide a limited warranty covering basic labor work performed under the terms of this auto repair contract. This warranty shall last for a period of One (1) calendar year from the completion of authorized Services. During the warranty period, Shugenja Autoworks will, at its sole cost and expense, correct any defects in workmanship related to the repairs performed in relation to this contract. This warranty covers labor and parts purchased through Shugenja Autoworks for standard repair services.
 

Custom Labor Warranty

Shugenja Autoworks shall provide a limited warranty covering custom labor work performed under the terms of this auto repair contract. This warranty shall last for a period of One (1) calendar month from the completion of authorized Services. During the warranty period, Shugenja Autoworks will, at its sole cost and expense, correct any defects in workmanship related to the repairs performed in relation to this contract. This warranty covers labor services only, and does not extend to any parts used for custom labor.  We do not warranty parts on custom labor services.
 
If you experience an issue directly related to work that was recently performed, contact Shugenja Autoworks IMMEDIATELY to arrange for diagnostics to check for and verify a warrantable failure. Warrantable failures can in most cases be addressed at no additional cost to you (generally excepting consumables such as fluids, etc. that are often not covered under warranties). If you experience a warrantable failure and wait on having it addressed, Shugenja Racing will likely not cover collateral damage caused by continued operation with a known problem.  IF You fail to contact Shugenja Autoworks in the event of a potential warrantable failure and proceed to have it inspected by another Mechanic outside of Shugenja Autoworks; Shugenja Autoworks will consider your Warranty VOID.  Shugenja Autoworks can not provide a warranty on a repair that has been tampered with.
 
ALL WARRANTIES ARE IMMEDIATELY RENDERED NULL AND VOID IF THE VEHICLE IS USED FOR RACING/TRACK USE, ABUSED IN A MANNER INCONSISTENT WITH ITS DESIGN AND INTENDED PURPOSE, OR MODIFIED OR TAMPERED WITH BY ANYONE, INCLUDING IT'S OWNER.
 
Shugenja Autoworks cannot and will not provide any warranty support for vehicles, or engines that are being worked on by someone else while it is being worked on by Shugenja Autoworks. If you perform any repair or service work on a vehicle we are working on (which is defined as "from the moment we start to the moment we finish, regardless of any intermediate delays, pauses, or wait time"), all warranties are null and void, regardless of what you did and whether it impacts Shugenja Autoworks work in any way. THIS IS NON-NEGOTIABLE AND NO EXCEPTIONS WILL BE MADE UNDER ANY CIRCUMSTANCES.
 
Binding Contract
This contract shall be considered binding upon both parties and their assignees or successors, including subsequent title holders for the vehicle being repaired / built.
 
Additional Services
No services outside of those described in this auto repair contract will be performed by Shugenja Autoworks without prior written or verbal approval from you.
 
Entire Agreement
This contract represents the entire legal agreement between Shugenja Autoworks and you. No other promises or arrangements outside of this contract and subsequent repair authorizations shall be considered valid excluding payment arrangement contracts agreed upon by both parties.
 
 
Penalty for Nonpayment
Most states allow auto repair shops to place mechanic’s’ liens on customers’ vehicles as a penalty for non-payment. Fees must be be paid for services approved.  They must be considered reasonable, and the services described must have been performed.  Shugenja Autoworks shall not be required to release the listed vehicle until you have made full payment for all services approved in writing or verbal agreement performed by Shugenja Autoworks.

In the event that auto repair services rendered are not paid without a prior payment arrangement within 5 Business days of completion, Shugenja Autoworks reserves the right add storage fees of $25.00 per day. In the event that services are still unpaid after 30days, Shugenja Autoworks reserves the right to sell parts from listed vehicle or entire vehicle as whole to recover the costs incurred while performing approved services.
 
These Terms have been updated as of 2024 and can be subject to change at any time.
